Delaware Sexual Harassment Training

Updated July 2023

Adhere to Delaware’s anti-harassment training regulations and improve workplace culture

In Delaware, employers with 50 or more employees are required to provide sexual harassment training to all employees. Training must be provided to all new employees within one year of their start date, and every two years thereafter.

Supervisory employees must receive additional training within one year of taking on a managerial role. This supplementary training must cover the specific responsibilities supervisors have in preventing and correcting sexual harassment, as well as the legal prohibition against retaliation.

How to comply with Delaware’s sexual harassment training laws and regulations

Training can be provided in person or online, but it must be interactive

Examples of topics that Delaware’s sexual harassment prevention training must cover but is not limited to:

  • The definition of sexual harassment
  • The consequences of sexual harassment
  • Employees’ right to be free from sexual harassment
  • Resources available to employees who have experienced sexual harassment
  • How to report and address sexual harassment complaints
  • Strategies to prevent sexual harassment in the workplace

Additionally, employers must post a notice in a prominent location that explains the rights and responsibilities of employees under the state’s sexual harassment laws. Employers with 4 or more employees must also distribute an information sheet on sexual harassment.

This is not intended as nor should be relied upon as legal advice, and we recommend all customers review their organization’s specific compliance requirements with dedicated legal counsel.
